Extradition

Extradition is the process by which an individual is delivered from state or nation where he is located, to the requesting state or nation in order to face prosecution or to serve a sentence. The participants in an extradition proceeding are either the two nations or two states and the individual.

Mortgage Fraud

Mortgage fraud has become a more prevalent crime in the past few years. In the last two to three years the number of mortgage companies has increased at a rate of at least 50%. As a result of the increase in the number of mortgage companies, mortgage brokers seem to be engaging in more and more fraudulent types of conduct. The Federal Bureau of Investigation has cited the increase in the number of cases involving fraud and mortgage brokers.

Wire Fraud

The federal Wire Fraud statute was enacted more than 50 years ago. The statute includes both domestic and foreign wire transmissions.

JURY INSTRUCTIONS ON ELEMENTS OF AN OFFENSE

The prosecution has the burden of proving all the elements of an offense with which a defendant is being charged. In accordance with this burden of proof, a trial court is required to specifically instruct a jury on all the elements of the offense. A jury instruction is defective if it fails to set forth all the elements of the offense.

CRIMES COMMITTED ABOARD AIRCRAFT

A person is guilty of a federal offense if he or she commits certain crimes aboard an aircraft. Such crimes include murder, attempted murder, manslaughter, attempted manslaughter, maiming, sexual abuse, assault, embezzlement, theft, receiving stolen property, and robbery. These offenses are punishable as federal offenses, even if they are not connected with aircraft piracy or attempted aircraft piracy.
